7 YEARS OLD – CHILDREN’S CONSENTS UNDER VIETNAM’S PERSONAL DATA PROTECTION LEGISLATION

In the initial drafts before Decree No. 13/2023/ND-CP on Personal Data Protection (“PDPD”), the processing of children’s personal data seemed not to be much drawn to the attention of the legislators. There were just several cases slightly mentioned in the impact assessment report and the proposal for the draft decree with reference to, for instance, the unauthorized access and collection of children’s personal data by YouTube and its consequence – a USD150 million fine. Subsequent drafts did set forth rudimentary requirements without any breakdown of different groups of children.

After many rounds of consultation, revisions, and updates, the final approved PDPD contains an article, among other provisions on the rights of data subjects in general, for this special group of data subjects and divides children by age to implement corresponding responsibilities of the relevant parties.
